Litigation and Trial

MAYR represents employees in all proceedings in both lower and higher labour courts in all German states and in the Federal Labour Court.

Every year, we successfully conduct more than 200 lawsuits, many of which involve claims of unlawful dismissal.

Each party is obliged to bear the costs of litigation, regardless of the trial’s outcome, at industrial tribunals. Billing is therefore based on the Federal Code of Lawyers’ Fees, and costs are covered – where applicable – by your legal expenses insurance.

Protection Against Unlawful Dismissals

MAYR represents individuals in all proceedings concerning dismissals for serious cause as well as for misconduct, operational or personal reasons.

In cases of termination, we support our clients by offering a strategic approach and undertaking all necessary legal actions to enforce claims at court. Should a termination be agreed upon mutually, we negotiate and draft cancellation agreements. We also help to avoid the suspension of unemployment benefits during any period of disqualification, as well as addressing other problems that may arise with the payment of such benefits.

Fees

Legal fees for employees are either specified by the Lawyers’ Compensation Act or based on time invested, according to your preferences.
