| Die Vertragsparteien einigen sich darauf, dass für das Arbeitsverhältnis Kurzarbeit im Sinne von §§ 95 ff SGB III eingeführt wird, um das Unternehmen während der Corona-Pandemie zu entlasten und den Arbeitsplatz des/der Arbeitnehmers/in möglichst zu sichern. Die Kurzarbeit beginnt am ___ und endet voraussichtlich am ___ . | The contracting parties agree that short-time work within the meaning of §§ 95 ff SGB III will be introduced for the employment relationship in order to relieve the company during the Corona pandemic and to secure the employee’s job as far as possible. | 2. Arbeitszeit | 2. Working Hours |
| 2.1. Die Arbeitszeit wird während der Kurzarbeit zunächst von ___ auf ___ Wochenstunden reduziert. Die Arbeitszeit wird wie folgt verteilt: (…) . 2.2. Da der Arbeitsausfall aufgrund der Unsicherheit der Sachlage nicht prognostiziert werden kann, kann die Notwendigkeit bestehen, die Kurzarbeit anzupassen. Die Arbeitszeit kann auch dahingehen angepasst werden, dass vom Arbeitnehmer/von der Arbeitnehmerin überhaupt keine Arbeitsleistung mehr erbracht wird („Kurzarbeit Null“). Bei Verbesserung der wirtschaftlichen Lage kann der/die Arbeitgeber/in die Kurzarbeit sofort abbrechen und den/die Arbeitnehmer/in jederzeit zur Wiederaufnahme der vollen Tätigkeit zurückrufen.
2.3. Die Arbeitszeit wird dem Arbeitsanfall wöchentlich angepasst. Die Anpassung wird 5 Tage zuvor in Textform dem/der Arbeitnehmer/in mitgeteilt.

As the loss of working hours cannot be forecast due to the uncertainty of the situation, it may be necessary to adjust the short-time working arrangements. The working hours may also be adjusted in such a way that the employee no longer performs any work at all (“zero short-time work” / “Kurzarbeit null”.). If the economic situation improves, the employer can terminate the short-time work immediately and recall the employee at any time to resume full employment.
2.3. The working hours are adjusted weekly according to the workload. The employee will be informed of the adjustment 5 days in advance in text form.

| 3. Kurzarbeitergeld und Aufstockung durch den/die Arbeitgeber/in | 3. Short-time allowance and additional payment by the employer |
| 3.1. Für die Dauer der Kurzarbeit vermindert sich das Arbeitsentgelt des/der Arbeitnehmers/in entsprechend. 3.2. Der/die Arbeitgeber/in stellt unverzüglich die erforderlichen Anträge zur Bewilligung von Kurzarbeitergeld bei der Bundesagentur für Arbeit. Die Berechnung und Auszahlung des Kurzarbeitergeldes erfolgt durch den/die Arbeitgeber/in. 3.3. Der/die Arbeitnehmer/in erhält vom Arbeitgeber/von der Arbeitgeberin eine Aufstockung des von der Agentur für Arbeit zu erwartenden Kurzarbeitergeldes auf ___% des Unterschiedsbetrages zwischen dem bisherigen Nettoeinkommen und dem tatsächlichen Nettoeinkommen nach Einführung von Kurzarbeit einschließlich des Kurzarbeitergeldes. Der Zuschuss zum Kurzarbeitergeld wird zusammen mit der üblichen Entgeltauszahlung gezahlt. Dies gilt unabhängig von dem Zeitpunkt der Auszahlung durch die Bundesagentur für Arbeit. Diese Aufstockung ist freiwillig und führt zu keinem Rechtsanspruch. Der Arbeitgeber kann jederzeit die Aufstockung einstellen. | 3.1. This increase is voluntary and does not result in any legal entitlement. The employer can stop paying the increase at any time. |
| 4. Urlaub und Krankheit | 4. Holiday Entitlement and Illness |
| 4.1. Für die Berechnung des Urlaubsentgelts nach § 11 BurlG bleiben Verdienstkürzungen infolge der Kurzarbeit außer Betracht. Wenn während des Bezuges von Kurzarbeitergeld Arbeitsunfähigkeit eintritt, besteht der Anspruch auf Kurzarbeitergeld fort, solange ohne den Arbeitsausfall Anspruch auf Fortzahlung des Arbeitsentgelts im Krankheitsfall bestehen würde.
4.2. Für den Bezug von Kurzarbeitergeld ist der Abbau von bestehenden Überstundenguthaben, Resturlaubsansprüchen und Urlaubsansprüchen, die noch nicht verplant sind, erforderlich. | 4.1.
