International Staff Deployment

Since its establishment, MAYR has worked on a number of cases involving the foreign deployment of employees. With a global network of highly qualified associates, we are uniquely able to represent clients on an international basis regarding the placement of staff abroad and the granting and extension of visas and work and residence permits, even at short notice. We also offer multilingual advice – in German, English, Dutch, French and Spanish – to national and international companies pertaining to tax and social insurance matters.

Termination Of Employment

In cases of termination, we provide support for employers with a strategic approach and knowledge of the legal actions required to enforce their claims in court. Should a termination be mutually agreed upon, we also negotiate and draft termination agreements. Furthermore, if a work relationship is terminated, we can help to avoid the suspension of unemployment benefits for the period of disqualification. Such circumstances, as well as other problems that may arise with the payment of such benefits, frequently impede or even prevent settlement agreements, something MAYR strives to prevent.

Additionally, our work over the years has familiarised MAYR with less usual examples of employment termination. These include such cases as the dismissal of handicapped people, for whom we can offer the necessary expertise to conduct proceedings before the agency responsible for equal employment opportunities.

Lawsuits And Trials

MAYR represents companies for all proceedings concerning Labour and Employment Law in both the lower and higher labour courts in all German states as well as in the Federal Labour Court. We also represent companies in legal disputes arising from service contracts at district courts and in the Courts of Appeals.
Every year, we successfully conduct more than 200 lawsuits, mainly involving unlawful dismissal claims, but also including arbitration proceedings concerning disputes between employers and works councils, as well as proceedings before conciliation committees.

Restructuring

If a reduction in personnel is inevitable, MAYR assists employers with the negotiation of agreements for reconciliation of interests as well as social compensation plans. We also take care of all necessary legal actions and develop restructuring plans in collaboration with our clients, helping them to find socially acceptable solutions e.g. the incorporation of transfer companies.

MAYR also offers legal advice regarding all matters of corporate acquisitions, the transfer of businesses or business units, and the in- or outsourcing of projects. In cases of company takeovers, we also undertake due diligence and help to negotiate the best possible terms.

Company Closures

The closure of a company can generate specific labour and employment law problems, such as the termination of working conditions and the negotiation of social compensation plans. MAYR helps affected companies plan and implement such closures.

Works Councils and Arbitration Committees

MAYR helps employers to avoid disputes with works councils and arbitration committees by establishing a basis for mutually satisfactory and successful cooperation. We offer legal advice on the co-determination rights of works councils regarding personal matters, and help companies conclude works agreements to protect their rights before arbitration committees.

In addition to legal advice, we provide legal education for HR personnel, and offer workshops and in-house classes on all legal matters concerning relationships between works councils and employers, as well as recent amendments to Industrial Relations laws.

Costs

Depending upon which is more convenient for the client, legal costs are usually determined according to the amount of time invested or by the Lawyers Remuneration Act. For regular clients, we can also discuss alternative payment arrangements for certain projects, including flat fees and modular compensation plans (combining predetermined flat fees and variables including time, labour and outcome).[/accordion]
